Terms of service

Last updated: 15 October 2026

The rules that apply when you use the site and when you buy services from us. We have written separate texts for those who buy the work for their business and those who buy it for themselves; open yours from the list below.

What is on this page?

Version 15.10.2026 (e). When you accept a quote, the version in force on that day is written into your acceptance record.

1. Site Terms of Use

1.1 Scope

These terms apply to everyone who uses wyvup.com and its subdomains (including hesap.wyvup.com), operated by Yiğit CENGİZ ("WyvUP", "we").

1.2 Information and prices on the site

Information about services, processes and prices is provided to inform you. What is binding is the quote we send to your account for your job and that you accept; the scope, duration, price and payment are stated there. Whether a price on the site includes or excludes VAT is stated next to the price. Payments are taken in Turkish lira (TRY).

1.3 Content rights

The text, design, code, logo, our mascot Ada, 3D scenes, videos and theme previews on the site belong to WyvUP or appear with permission for use. They may not be copied, reproduced or sold without permission. The sites, images and brands in the References section belong to the customers concerned and appear only with their permission, to show the work we have done. Short quotations may be made provided WyvUP and a link to the page are cited as the source.

1.4 Use we do not accept

  • Attempting to bypass the security of the site or the account, to gain unauthorized access to the server, or to disrupt the site,
  • Placing an unusual load on the site with automated tools,
  • Downloading and using theme previews or source code without a license,
  • Writing to us on behalf of someone else or with misleading information, or opening an account on behalf of someone else.

1.5 Links to other sites

The site contains links to WhatsApp, the Chrome Web Store, Google and our customers' sites. The content and privacy practices of these sites are the responsibility of their owners.

1.6 Liability

We take care to keep the site accurate and up to date; even so, we cannot guarantee that it will operate without interruption or error. To the extent permitted by law, we are not liable for indirect losses arising from decisions made on the basis of the general information on the site. Our liability arising from intent and gross negligence and your statutory rights as a consumer are reserved in all cases.

1.7 Applicable law

These terms are governed by the law of the Republic of Türkiye. For service work, the dispute rules are set out in the Terms of Service below.

2. How a contract is concluded online

This section explains what you need to know before a contract is concluded, as required by Article 3 of Law No. 6563 on the Regulation of Electronic Commerce.

  1. Quote. After we have discussed your job, we send the quote to your account and notify you by e-mail. The quote states the items, the total price with a VAT breakdown, the duration, the revision entitlement and the validity date. The quote is free of charge; it does not bind you unless you accept it.
  2. Invoice details. On the quote page, you choose the details the invoice will be issued with: individual (consumer) or corporate (business). Depending on your choice, one of the two versions below applies.
  3. Reading and approving the texts. If you chose corporate, you approve the quote and the business version of the Terms of Service; if you are accepting on behalf of a company, you declare that you are authorized to do so. If you chose individual, the pre-information form and the distance service contract open on the same screen; you approve the two with separate checkboxes. No checkbox is pre-ticked.
  4. E-mail code. We send a 6-digit code to your registered e-mail address. The contract is concluded when you enter the code and press the "I approve; a payment obligation arises" button.
  5. Confirmation. Immediately after acceptance, we send the acceptance document and the payment information by e-mail. For individual acceptances, the pre-information form and the distance service contract are also attached as PDFs.

Where is the text stored, and for how long? The quote you accepted, the acceptance document and (for individuals) the pre-information form and the distance service contract remain in your account; you can download them at any time as long as your account stays open. We keep these documents and the acceptance record for 10 years; after your account is closed, we will send you a copy if you wish. All versions of the Terms of Service are kept and are sent on request.

How do you correct errors? Before the code step, you can go back with "Change selections" and change the invoice details and the checkboxes. You correct a mistake in the invoice details in the "My invoice details" section of your account. If you see an error in the content of the quote, write to us without accepting; we will send a corrected new version. Also write to us about an error you notice after acceptance; the correction is made in writing, by an additional quote or a corrected document.

Language and contact. The language of the contract is Turkish. For your questions and complaints: destek@wyvup.com, 0545 510 84 75 or our registered electronic mail (KEP) address yigit.cengiz@hs01.kep.tr. Your personal data is processed in accordance with the rules on the Privacy and KVKK (Turkish Personal Data Protection Law, Law No. 6698) page.

3. Terms of Service: business version

Version 15.10.2026 (e). This version applies to companies, sole proprietorships and self-employed professionals who buy the work for their commercial or professional activity, that is, those who accept the quote with corporate invoice details.

Please read these in particular. The clauses below may not always appear in an ordinary service contract; we draw them to your attention before you accept:

  • İ2: Your payment of the quote price also counts as acceptance of the quote and these terms.
  • İ4: Prices exclude VAT unless otherwise stated.
  • İ9: If you do not respond to the preview within the time allowed, the delivery is deemed accepted; after acceptance, only hidden defects can be notified.
  • İ17: Our liability, in the case of slight negligence, is limited to the price you paid for that job in the last 12 months; indirect loss and loss of profit are not covered.
  • İ18: WyvUP is bound only by a numbered, verifiable quote issued from our system.
  • İ19: You accept our system records as evidence.
  • İ21: If you cancel after work has started, a cancellation fee is deducted from what you paid, at the rate stated in the quote or order. If the rate is 100%, the price paid is not refunded. You approve this clause separately at acceptance and at the payment step.

İ1. Parties and scope

These terms apply to all work between Yiğit CENGİZ (sole proprietorship, Şirinyer Tax Office (İzmir), Tax ID No. 2061110714, Adalet Mah. Manas Bulvarı Folkart Towers B Kule No:39 Kat:25 Kapı No:2511, 35530 Bayraklı / İzmir) and the business receiving services from WyvUP (the "Customer"). The scope, price and duration of each job are stated in the quote for that job; if the quote and these terms conflict, the quote prevails.

WyvUP does the following work: web design (designing, building and publishing the site), media (video shooting and editing, photography, graphic and logo design, social media content) and advertising (setting up and managing advertising campaigns on platforms such as Meta, Google and TikTok, social media account management). WyvUP does not sell hosting, site maintenance, domain name registration, a separate search engine optimization (SEO) service or custom software development for the customer.

For web design work, where the site will be published is stated in the quote; the domain name is registered in the Customer's name. If the site will be published on the Customer's hosting account, hosting and domain name fees are paid directly to the provider. If WyvUP agrees to publish a site on its own infrastructure, this is not a separate service and is not charged separately; WyvUP gives no commitment as to any specific period, uninterrupted operation or accessibility and may, by giving at least 30 days' prior notice, request that the site be moved to the Customer's own account; it gives the Customer the files and access needed for the move. Building the site in a structure that search engines can read is part of the design; no commitment is given as to search ranking, traffic or sales results. Changes requested after publication are made under a new quote. Sites built before these terms and live on WyvUP's infrastructure are subject to a separate agreement made with their owners.

İ2. Conclusion of the contract

The contract is concluded when the quote is accepted in the account with the e-mail code (section 2). If the Customer accepts the quote in writing by WhatsApp or e-mail, our team records this acceptance in the system after sending the Customer the Terms of Service link; the contract is concluded as of the moment of written acceptance. Payment of the quote price also counts as acceptance of the quote and these terms. If the Customer does not object within 8 days to the confirmation e-mail we send after acceptance, the Customer is deemed to have accepted the confirmed content (Turkish Commercial Code Art. 21/3).

İ3. Scope and change requests

WyvUP does only the work stated in the quote. Any work not stated in the quote is out of scope. A request that changes the scope, the direction or the amount of work is not a revision but a change request; it is carried out under an additional quote, and work does not start until the additional quote is accepted.

İ4. Price and taxes

Prices exclude VAT unless otherwise stated. VAT is added separately at the legal rate on the invoice date; the quote also shows the VAT breakdown and the VAT-inclusive total separately. Payments are taken in Turkish lira (TRY). The price in the quote does not change during the quote's validity period.

İ5. Payment

The full price is paid in advance at acceptance, before work starts. Payment is made by bank transfer or EFT to the bank account stated in the payment request in the account or, once card payment is enabled, through iyzico; no surcharge is applied to card payments. Work does not start, and final files and access are not provided, until payment is complete. We start work in our first working hour after payment is received (weekdays; excluding public holidays); we state the start time in the payment e-mail. For monthly services, the price of each period is paid in advance at the start of the period; for a period not paid when due, we send a reminder, give a suspension notice after 15 days and may suspend the service after 30 days. Statutory default interest applicable to commercial transactions (Law No. 3095 Art. 2/2) accrues on the overdue amount. If the Customer receiving the invoice does not object to its content within 8 days, the Customer is deemed to have accepted the content (Turkish Commercial Code Art. 21/2).

İ6. Customer's obligations and delay

The Customer provides the content, access and approvals the work requires within the time stated in the quote. In the event of a delay attributable to the Customer, the delivery time is extended by the same amount. If required information or approval has not arrived after 30 days, WyvUP may suspend the work; if it has not arrived after 90 days, WyvUP may terminate the contract by written notice. In this case, the cancellation rule in İ21 applies.

The Customer declares that it holds the necessary rights and permissions for all material it gives us (text, images, logos, video, trademarks, images of persons). The Customer is responsible for claims arising from this material and compensates WyvUP for any loss it suffers as a result.

İ7. Revisions

The number of revision rounds stated in the quote is included in the price. A revision is a correction within the approved scope and direction. One round is all the corrections sent in a single list. Correction of errors by WyvUP that do not match the quote or the delivery is always free of charge and does not count toward the number of rounds. Once the included rounds are used up, further rounds are charged under an additional quote.

İ8. Delivery

Delivery has two stages: first a preview that cannot be downloaded from the account, then final delivery once approval and payment are complete. Final files are downloaded from the account. For a website, final delivery is the publication of the site at the place stated in the quote. Details are on the Delivery Terms page.

İ9. Acceptance and tacit acceptance

If you do not approve the preview or request a revision within the period stated on its page (7 days in this version), the delivery is deemed accepted. The Customer is obliged to review what is delivered within this period and to notify any defect it sees (Turkish Code of Obligations Art. 474). After express or tacit acceptance, notice may be given only for hidden defects that could not be noticed at first inspection; a hidden defect must be notified as soon as it is discovered (Art. 477). WyvUP's liability for defects it intentionally concealed is reserved.

İ10. Intellectual property rights and usage license

  1. Intellectual property rights in the work WyvUP produces remain with WyvUP. Once the full price is paid, the Customer is granted a perpetual, worldwide usage license to use the work for the purpose stated in the quote. The license covers the following rights (Law No. 5846 on Intellectual and Artistic Works Art. 21–25): adaptation (updating and adapting the text, images and content of the work for its own business), reproduction (copying, printing, backing up), distribution (distributing copies within the scope of its own business), performance and communication to the public (publishing and displaying on the internet, on social media, in advertising, on television and in physical settings).
  2. For work produced specifically for the Customer (logo, the site's design, video and photographs shot for the Customer), the license is exclusive: WyvUP does not sell or license the same work to anyone else. General tools, code fragments, templates and methods that WyvUP uses in all its work fall outside this exclusivity; the Customer uses them only as part of the delivered work.
  3. The license belongs to the Customer; transferring it to another party or allowing it to be used in another party's business requires WyvUP's written approval. On a transfer or merger of the Customer's business, the license passes to its new owner.
  4. A full transfer of rights is made only by a separate written contract, with a secure electronic signature or a wet-ink signature; the rights transferred are listed individually in that contract.
  5. Previews and drafts shown before the price is paid are for evaluation only; they may not be used. Open source components and licensed stock materials are subject to their own licenses.
  6. If the quote states a separate license scope, that scope applies. Because contracts concerning intellectual property rights must be in writing (FSEK Art. 52), for work whose amount exceeds the limit for proof by written instrument (HMK Art. 200), or if the Customer so requests, the license document is separately signed with a secure electronic signature or a wet-ink signature.

İ11. Artificial intelligence

WyvUP may use artificial intelligence tools in its work, under paid licenses (such as image generation, text drafts and editing). Our team selects, edits and checks the elements produced with these tools. What you need to know:

  • Copyright protection may not arise for elements produced with artificial intelligence without sufficient human contribution. WyvUP gives no commitment of exclusivity for these elements; the Customer is aware that similar elements may also be produced by others.
  • These elements are subject to the terms of use of the tool that produced them; WyvUP uses only tools that permit commercial use.
  • Content imitating a real person's appearance or voice is not produced. In advertisements that use an artificial intelligence image or voice with the appearance of a real person, this is clearly disclosed.
  • If you want a job done without artificial intelligence, tell us at the quote stage; we will write it into the quote.

İ12. Stock and third-party material

We use free stock material only exceptionally and by stating it in the quote; licensed stock material is stated in the quote. On delivery, the source and license of each material are stated in the material and license declaration. If a third party asserts a right over a material we used, we replace the material free of charge.

İ13. Portfolio

WyvUP shows the work and the Customer's name or logo in its portfolio and promotion only with the Customer's permission. Permission is given through an optional checkbox at the acceptance step; the Customer may withdraw permission at any time from its account or by e-mail, and the work is removed from the portfolio within 15 days at the latest. Confidential information and personal data are not shown in the portfolio; if an image shows an identifiable person, that person's separate written permission is obtained.

İ14. Confidentiality

The parties keep confidential the commercial information they learn from each other. Publicly available information, information obtained independently of the other party and information that must be disclosed by law are excluded. The confidentiality obligation lasts for 3 years after the work ends. If the Customer wishes, a separate mutual confidentiality agreement is signed.

İ15. Personal data

Each party is the controller of the personal data it collects. The data WyvUP processes in connection with the Customer's account is set out on the Privacy and KVKK page. If WyvUP needs to process personal data on the Customer's behalf for a job (e.g. a file containing information about the Customer's own customers), the parties make a separate written data processing annex.

İ16. Third-party platforms

Advertising, social media, hosting, domain name, payment and artificial intelligence services are subject to the terms of third-party platforms. The advertising budget is paid directly to the platform; the price paid to WyvUP is only the service fee. WyvUP is not liable for platforms' decisions (account closure, ad rejection, algorithm or price changes, outages) unless it is itself at fault. In advertising and social media work, no sales, reach or engagement result is guaranteed; WyvUP undertakes to carry out the work with care.

İ17. Limit of liability

WyvUP's liability under these terms, in the case of slight negligence, is limited to the price the Customer paid in the last 12 months for the job that caused the loss. There is no liability for indirect loss or loss of profit. The Customer is obliged to back up its own data and accounts. Liability arising from intent and gross negligence is not limited (Turkish Code of Obligations Art. 115).

İ18. Binding quote

A binding quote on behalf of WyvUP is given only by a document generated from the WyvUP system, bearing a number beginning with T- and verifiable with a verification code. Prices and durations given by team members in correspondence are for information only; they become binding when entered in the system and sent to the Customer as a quote.

İ19. Records and evidence

The parties agree that the records of the WyvUP system (approval records, document hashes, timestamps, e-mails sent, delivery and download records) constitute evidence in disputes between them (Code of Civil Procedure Art. 193). The right to prove the contrary of these records by any means of evidence is reserved.

İ20. Notices

Notices may be given through the account, the e-mail address registered in the Customer's account, or WhatsApp. Default, termination and rescission notices between merchants are given through a notary, by registered letter or by registered electronic mail (KEP) with a secure electronic signature (Turkish Commercial Code Art. 18/3). WyvUP's registered electronic mail (KEP) address: yigit.cengiz@hs01.kep.tr.

İ21. Cancellation and termination

  • Cancellation before work starts: the price paid is refunded, less any documented expenses incurred for the work.
  • Cancellation after work has started (cancellation fee): if the Customer terminates the contract after work has started, a cancellation fee at the cancellation fee rate stated in the quote or order for that job is deducted from the price paid; the remainder is refunded. If the rate is 100%, the price paid is not refunded. The rate becomes part of the contract at the moment of acceptance or order and does not change afterward; it is also shown separately on the acceptance screen and at the payment step and is approved with a separate checkbox (Turkish Code of Obligations Art. 484 and Art. 21). The moment work starts is stated in the "We have started work" e-mail sent to the Customer and in the account.
  • Monthly services: either party may terminate with 30 days' prior written notice; the service continues until the end of the paid period.
  • If the work cannot be done for a reason attributable to WyvUP: the full price paid is refunded.
  • Serious breach: the parties may terminate the contract immediately by written notice.

Refunds are made to the account or card from which payment was made, within 14 days at the latest after the cancellation becomes final. Details are on the Cancellation, Withdrawal and Refunds page.

İ22. Price updates

For one-off work, the accepted price does not change. For monthly services, the price may be updated at most once a year, with at least 30 days' prior written notice, by the rate of change in the consumer price index (CPI) over the last twelve months as published by TÜİK, unless the quote states another method. If the Customer does not accept the new price, it may terminate without penalty until the effective date.

İ23. Force majeure

For events beyond the parties' control (natural disaster, epidemic, infrastructure and platform outages, changes in legislation), the affected obligations are suspended for the duration of the event. If the suspension exceeds 60 days, either party may terminate the contract by written notice; in this case no cancellation fee is deducted, the price of the work done up to that point is deducted and the remaining amount is refunded.

İ24. Disputes

The law of the Republic of Türkiye applies. The İzmir courts and enforcement offices have jurisdiction over disputes. The requirement to apply to a mediator before filing a lawsuit in commercial cases is reserved.

İ25. Changes

WyvUP may update these terms. A new version applies only to new work; ongoing work remains subject to the accepted version.

4. Terms of Service: consumer version

Version 15.10.2026 (e). This version applies to persons who buy the work for themselves, for a non-commercial and non-professional purpose. We apply this version to everyone who accepts a quote with individual invoice details, regardless of the purpose for which they buy the work. This version is an annex to the pre-information form and the distance service contract you approve at acceptance; if there is a difference between them, the one more favorable to you applies. Your rights under Law No. 6502 on Consumer Protection cannot be narrowed by any clause in this text.

T1. Parties and scope

Service provider: Yiğit CENGİZ (sole proprietorship, Şirinyer Tax Office (İzmir), Tax ID No. 2061110714, Adalet Mah. Manas Bulvarı Folkart Towers B Kule No:39 Kat:25 Kapı No:2511, 35530 Bayraklı / İzmir). The scope, total price and duration of the work are stated in the quote and the pre-information form.

WyvUP does web design (designing, building and publishing the site), media (video, photography, graphic and logo design, social media content) and advertising (setting up and managing advertising campaigns) work. It does not sell hosting, site maintenance, domain name registration, a separate SEO service or custom software development for you. Where the site will be published is stated in the quote; the domain name is registered in your name. If the site will be published on your own hosting account, you pay hosting and domain name fees directly to the provider. If WyvUP publishes a site on its own infrastructure, it does not charge separately for this; it gives no commitment as to any specific period or uninterrupted operation and may, by giving at least 30 days' prior notice, request that the site be moved to your account; it gives you the files and access needed for the move. No commitment is given as to search ranking or sales results.

These terms are for one-off work. We do not offer consumers automatically renewing subscriptions; if you want monthly work, each period is handled under a separate quote.

T2. Conclusion of the contract

The contract is concluded when you approve the pre-information form and the distance service contract with separate checkboxes and press the "I approve; a payment obligation arises" button with the e-mail code (section 2). The contract is not concluded unless you approve the pre-information form; if a payment reaches us in such a case, we refund the full payment. Making a payment does not by itself conclude the contract. The two documents are sent to your e-mail as PDFs and are stored in your account.

T3. Scope and additional requests

Any work not stated in the quote is out of scope. For an additional request, we prepare a separate quote; no additional work is done and no additional payment is requested from you unless you approve it.

T4. Price and taxes

Prices include all taxes. The total stated in the pre-information form is the entire amount you will pay; it does not change after acceptance. Payments are taken in Turkish lira (TRY). No surcharge is applied for the payment method.

T5. Payment and start of work

The full price is paid in advance at acceptance or order, before work starts: by bank transfer or EFT to the bank account stated in the payment request in your account or, if card payment is available, through iyzico. For individual orders and individual quote acceptance, you give the "I want the service to start immediately" approval; without this approval, an order cannot be placed and a quote cannot be accepted. With your approval, we start your work in our first working hour after your payment is received (weekdays; excluding public holidays). We state the start time in the "Your payment has been received" e-mail and in your account; when we start, we send a "We have started work" e-mail. Your right of withdrawal ends the moment work starts (Distance Contracts Regulation Art. 15/1-h). Until then (within 14 days from the day the contract is concluded), you may withdraw from the contract; the full amount you paid is refunded.

T6. Right of withdrawal

You may withdraw from the contract within 14 days from the day it is concluded, without giving any reason and without paying a penalty. It is enough to use the "Withdraw from the contract" button in your account or to write to destek@wyvup.com. If you withdraw before work starts (even if your payment has been received), any amount you have paid is refunded in full to the account from which you made the payment, within 14 days of your withdrawal notice; no deduction is made. Because you approved the service starting immediately, we start your work in our first working hour after your payment is received, and your right of withdrawal ends the moment work starts (Distance Contracts Regulation Art. 15/1-h; T5). Details are on the Cancellation, Withdrawal and Refunds page.

T7. What we expect from you

We ask you to provide the content the work requires (text, images, logo) and approvals within the time stated in the quote. If this takes longer, the delivery time is extended by the same amount. If we do not hear from you for 30 days, we put the work on hold and write to you; we continue from where we left off whenever you wish. If we do not hear from you for 90 days, we may terminate the contract; in this case, the refund rule in T18 applies. You declare that you hold the necessary permissions for the materials you give us; in particular, if an image shows another identifiable person, you must have obtained that person's permission.

T8. Revisions

The number of revision rounds stated in the quote is included in the price. One round is all the corrections you send in a single list. Correction of our errors is always free of charge and does not count toward the number of rounds. Your not responding to a revision does not mean you have accepted the work; only the delivery is deemed made, as in T9. Once the included rounds are used up, we prepare a separate quote for an additional round.

T9. Delivery

We first open a preview that cannot be downloaded from your account. You may approve the preview or request a revision. If you do not respond to the preview within the period stated on its page (7 days in this version), delivery is deemed made and the final files are made available in your account. This does not remove your rights under Law No. 6502 if you find the work defective; your rights regarding defective services are reserved. Details are on the Delivery Terms page.

T10. Defective service

If the delivered work is incomplete or faulty compared with what is stated in the quote and the pre-information form, you may choose one of the following rights under Article 15 of Law No. 6502: having the work redone free of charge, having the defect remedied free of charge, a price reduction in proportion to the defect, or rescission of the contract. You may use these rights within 2 years from delivery (Art. 16); this period does not apply if we concealed the defect through gross negligence or fraud. It is enough to write to us.

T11. Intellectual property rights and usage license

  1. Intellectual property rights in the work we produce remain with WyvUP. Once the full price is paid, we grant you a perpetual, worldwide usage license to use the work for the purpose stated in the quote. The license covers the following (Law on Intellectual and Artistic Works Art. 21–25): updating and adapting the text, images and content of the work for yourself; copying, printing, backing up; distributing; publishing and displaying on the internet, on social media and in other media.
  2. For work produced specifically for you (logo, your site's design, video and photographs shot for you), we do not sell or license the same work to anyone else. General tools, code fragments, templates and methods we use in all our work are excluded from this; you use them as part of the delivered work.
  3. To transfer the license to another party or to allow it to be used in another party's business, you must ask for our written approval.
  4. A full transfer of rights is made only by a separate written contract, with a secure electronic signature or a wet-ink signature.
  5. Previews and drafts shown before the price is paid are for evaluation only. Open source components and licensed stock materials are subject to their own licenses. If the quote states a separate license scope, that scope applies; if you wish, we separately sign the license document with a wet-ink signature or a secure electronic signature.

T12. Artificial intelligence and stock material

We may use artificial intelligence tools in the work, under paid licenses; our team selects, edits and checks the elements produced. Copyright protection may not arise for elements produced with artificial intelligence without sufficient human contribution; we give no commitment of exclusivity for these elements. We do not produce content imitating a real person's appearance or voice. If you want a job done without artificial intelligence, tell us at the quote stage; we will write it into the quote. We use free stock material only exceptionally and by stating it in the quote; the source and license of each material are stated on delivery. If a third party asserts a right over a material, we replace the material free of charge.

T13. Portfolio

We show the work and your name in our portfolio only with your permission. You give permission through an optional checkbox at the acceptance step; you may withdraw it at any time from your account or by e-mail, and the work is removed from the portfolio within 15 days at the latest. Confidential information and personal data are not shown in the portfolio; if an image shows an identifiable person, that person's separate written permission is obtained.

T14. Personal data and confidentiality

Your personal data is processed in accordance with the rules on the Privacy and KVKK page. We keep confidential the information you tell us and that we see as required by the work.

T15. Third-party platforms

Advertising, social media, hosting, domain name and payment services are subject to those platforms' terms. You pay the advertising budget directly to the platform. To the extent permitted by law, we are not liable for the platforms' own decisions (account closure, ad rejection, outages); our liability arising from our own fault is reserved. In advertising and social media work, no sales or engagement result is guaranteed; we undertake to carry out the work with care.

T16. Liability

Our liability under the law is not limited by these terms.

T17. Records and our team's correspondence

Our system's records (approval records, document hashes, timestamps, e-mails sent) may be submitted as evidence in a dispute; your right to prove the contrary is reserved. Commitments our team gives you in correspondence also bind us; to avoid confusion, we enter everything we agree on in your account as a quote.

T18. Cancellation and refunds

  • Within the withdrawal period and before work starts: the full amount you paid is refunded; no deduction is made (T6).
  • After work has started: you may stop the work at any time before it is finished. If you cancel after work has started, the price of the work done up to that point and of the time set aside for the work is deducted; the remaining amount is refunded (Turkish Code of Obligations Art. 484). There is no fixed deduction rate: we calculate the deducted amount according to the work done and write to you with the reasons. We show the work done through the previews and files we deliver.
  • If the work cannot be done for a reason attributable to us or delivery is delayed by more than 30 days beyond the time stated in the quote for a reason attributable to us: the full amount you paid is refunded.

Refunds are made within 14 days at the latest, to the account or card from which you made the payment.

T19. Price changes

The total price you accepted does not change. If the quote provides for payment spread over more than one period, the price may change only according to the method stated in the quote (TÜİK consumer price index) and with at least 30 days' prior notice; if you do not accept the new price, you may terminate the contract without penalty.

T20. Force majeure

For events beyond the control of both of us (natural disaster, epidemic, infrastructure outage), the affected obligations are suspended for the duration of the event; we notify you immediately. If the suspension exceeds 30 days, you may terminate the contract under the refund rule in T18.

T21. Complaints and disputes

You may submit your complaint through destek@wyvup.com, by phone or through our registered electronic mail (KEP) address (yigit.cengiz@hs01.kep.tr). For disputes below the monetary limit announced each year by the Ministry of Trade, you may apply to the consumer arbitration committee where you reside or where you carried out the transaction; for disputes above the limit, you may apply to the consumer court, on condition that you apply to a mediator before filing a lawsuit (Law No. 6502 Art. 68 and 73/A).

T22. Changes

We may update these terms. A new version applies only to new work; your ongoing work remains subject to the version you accepted.
